Any personal information you provide and/ or register on the Website will be stored on a GM Modular server located in Mumbai India.

Services means any functions, facilities, information, promotions or other services through this Website relating to GM Modular Products including downloading images, screensavers and wallpapers as well as other products; transmission general news and information.

Terms means these terms and conditions, GM’s privacy policy and any other rules that may be posted on the Website.

User means any person who accesses or uses the Website with GM’s authorisation after registering on the Website.

Requirement for the registration is the acknowledgement and acceptance of the terms and conditions for the use of www.gmmodular.com as presented. If the User receives a password, it shall mean that GM has accepted the registration, and the User may log to the services of www.gmmodular.com with the use of the password.
The Website may contain board(s)or other forms of communication broadcasting. When a User uploads or posts an article(s), it may be displayed on the Website after confirmation of GM. In case of inappropriate post, it may not be displayed. Any images or articles that have been posted by a User, which are related to products other than those manufactured by GM, can be removed without prior notice. GM reserves the right to delete or remove any messages or articles posted by the User at any time without prior notice. The views or comments made in the bulletin boards do not reflect the views of GM.
GM reserves the right to terminate a User account at any time without prior notice should a User misuse the Website or Services, or use the Website or Services in an unlawful, abusive or any other manner that GM deems to be inappropriate or offensive.
www.gmmodular.com constitutes an additional, voluntary and free of charge service from GM. Any entitlements to these services or to parts of these services are not given. GM is entitled at any time and in any manner to restrain or to completely cease the use of www.gmmodular.com.

Duties of the Use

The User of www.gmmodular.com undertakes to submit true and complete information required for registration. If there are changes to this data, the User will inform www.gmmodular.com thereof without delay.
The access to www.gmmodular.com is only available to all Users. The granting of rights or enabling access to or for non-authorised third parties, in any manner or form whatsoever, is not permitted. The User is responsible for non-disclosure of his password.
The User is prohibited from, no matter in which manner, inducting single data or records in the service of www.gmmodular.com and thereby modifying or corrupting the GM system or making it available to third parties. The User undertakes to indemnify GM against claims of third parties, which are lodged as a result of incorrect User data.

Warranty

The information and products available on this Website were compiled with great diligence. GM can give no warranty for timeliness, correctness or completeness of the information and products provided. GM cannot guarantee the Website to be free from faults and without interruptions. GM can incur no liability for actions and decisions made on the basis of this information or these products.
GM shall endeavor to protect the information provided against viruses, but a warranty for freedom of viruses shall not be given.
GM is convinced that the products and possible pointers and links within the Website are free of illegal contents. GM has no influence on the present and future presentation as well as the contents of linked Websites. Thus, GM explicitly dissociates from the contents of all linked Websites. No liability shall be incurred for illegal, deficient contents and especially not for corruptions resulting from the utilisation or non-utilisation of such offered information.

Data Protection

GM shall comply with the requirements of the data protection.
One of the basic principles of GM is not to pass on personal data of Users to third parties. However data can be transferred to a company in pursuance of any Business Agreement or Contract that ensures the same level of data protection that is adhered to by the body corporate as provided under applicable Rules.
In the case of cookies placed in a file of the browser of the User’s computer, GM will provide for the data to be collected by means of a cookie not being connected to the User, so long and as the User is not informed as to which data is collected and if he has not agreed to a collection of his data. If the User declares his consent, the cookie will only record the general structure of use and be used to identify the User.
The User may forbid GM at any time from directly contacting him for advertising or marketing purposes. The User is entitled to obtain information about his data recorded, to inspect such data and to request correction of such data.
On termination of a service subject to the registration of www.gmmodular.com, the data stored for the User will be deleted upon the effective notice date, unless further safe custody is envisaged by law.

Copy and Trademark Rights

All industrial property rights on products (patents, trademarks, copyrights, design rights, know-how and processes), which are presented, used or made accessible in any manner under www.gmmodular.com shall remain with GM in full or with the respective licensor.
Users of www.gmmodular.com are entitled to save the products received on their equipment; however they are not entitled to transfer the aforesaid to other items of equipment or to third parties.

Modifications on Instructions of Use

GM reserves the right to modify the instructions of use at any time without specifying the reasons in question. Users of www.gmmodular.com will be informed thereof on the Website www.gmmodular.com. The modifications shall be taken as valid if after publication the User continues to use the service of www.gmmodular.com without objecting in written form within a month after publication. Upon an objection within the period of one month, GM is entitled to delete the respective registration without further notice.

Applicable Law

All legal transactions concluded between GM and a client shall be governed by the Laws of India and of the courts situated at Mumbai Jurisdiction only.

Public Notice

It has been brought to our notice that certain unscrupulous individuals/fraud entities (who are in no manner associated with us and indeed are strangers with no whereabouts) are issuing misleading advertisement & communications by offering various lottery/schemes to the general public with an intent to defraud them. Such activities are generally being done through announcement though private communications in the form of lottery/winning announcement, sweepstakes etc. to the public and individuals through emails, SMSs and/or by other mode (generally private communications), which are all part of phishing scams. Any response to such communications where personal details are being sought could result in access and misuse of your personal identity/information. In some instances they also convince and allure people to deposit cash (once and on repeated occasions) in certain specified bank(s) and/or visit links and/or provide their communication address and/or contact details to release the non-existent prizes. These individuals/entities are fraudulently and illegally misusing our company’s Trademark/Corporate name and/or Trade or brand names to lure the innocent member of the public.
It is informed and cautioned to our valued customers, patrons and also the public at large not to act upon such fraudulent and misleading communications, which are being sent with the intent to cheat the public. Please note that GM is in no way associated with these entities and are not involved in any such lottery-winning announcement or any phishing activities whatsoever.
Any person who deals with such individual entity shall be doing so at her/his own risk and our company shall not be responsible and liable for any loss and/or consequences arising there from.

GM Bandhan Terms and Conditions

Welcome to GM Bandhan (hereinafter referred to as “App”). The Loyalty Program is operated by GM Modular Private Limited ("We", "Us", or "Our" where such expression shall unless repugnant to the context thereof, be deemed to include its respective legal heirs, representatives, administrators,permitted successors and assigns). Please read these terms and conditions carefully as they contain the legal terms and conditions that you agree towhen you use the service provided by us through the App.
This GM Modular Pvt Ltd. Loyalty Program “GM Bandhan” is exclusively designed for the Retailers and Electrician: Retailer– a person or a company who selles electrical goods including GM products to the public in a shop. Electrician – a person possessing the skill to install/uninstall/operateelectrical products.
GM Modular Private Ltd. reserves the right to decline, issue, withdraw, alter, amend or terminate the program at any time without prior notice. Participants in the Program may be removed from the Program at any time at the discretion GM Modular Pvt. Ltd. and with or without providing anynotice of whatsoever nature.
All participants in the Program must be a citizen of India and must be at least 18 years old on the date of registration with GM Modular loyalty program.
The Loyalty Program shall commence from October 2024 and shall be valid until GM Modular Pvt Ltd. at its sole discretion decides to terminate the Loyalty Program.
Retailer/Electrician needs to register himself for the first time on the iOS App/ Google Play Store/ Android App by creating a login account in order to getthe reward points credited to the login account. App details: Please search for GM Bandhan on iOS App/ Google Play Store Android App.
As a part of the registration process, you agree to provide current, complete, and accurate registration information as prompted and to maintain and update this information as required to keep it current, complete and accurate.
If you provide any information that is untrue, inaccurate, not currently true, or incomplete GM Modular Pvt Ltd has reasonable grounds to suspect that such information is untrue, inaccurate, not currently true or incomplete, GM Modular Pvt Ltd has the right to indefinitely suspend or terminate your account forthwith without any further notice to you.
The registration for the loyalty program is non-transferable. It can only be used by the original applicant only.
The information and services may contain bugs, errors, problems, or other limitations. All responsibility or liability for any damages caused by usage of the App is disclaimed.
GM Modular Pvt Ltd. will advise from time to time the software such as Browsers, App which is required for using the Loyalty program account. There will be no obligation on GM Modular Pvt Ltd. to support all the versions of the App, Internet Browser to make it compatible with your smartphone, tablets, laptop, desktop etc. The User shall upgrade his software, hardware and the operating systems at his own cost from time to time and the GM Modular Pvt Ltd. shall be under no obligation to support the software, hardware, operating systems of the User and that the same shall be the sole responsibility of the User.
Every user id for the loyalty program shall be the registered mobile number and the password shall be PIN created by the user or the OTP received by the registered user on his mobile phone.
The products showcased in the app are subject to change and upon the discretion of GM Modular Pvt Ltd.
Points can be collected against the purchase of GM Modular manufactured products, post May 2021. GM Modular Pvt. Ltd. reserves the right to increase or decrease the validity of the reward points at its sole discretion with an intimation of notice to all the stakeholders of the program. All rewards, if any, must be availed of within the time period and non-availment of the reward points before the expiry shall result in the reward points getting lapsed.
Every respective packaging of the GM Bandhan box of GM Modular PvtLtd. shall contain a QR code on the outer and inner packaging or coupon inside the box.
The QR code needs to be scanned from the registered account on GM Bandhan App by Retailers / Electricians.
The QR code mentioned on the box of GM Modular Pvt Ltd. can be used only once for collecting the reward points. Subsequent use of code is forbidden and shall lead to suspension or cancellation of Registered Account forthwith.
The account holders are responsible for the proper use and security of their account, and the points accumulated in the App. In case of any security breach at the Retailer or Electrician end i.e. unauthorized use of Account holders Loyalty program etc., GM Modular shall not be liable and shall not takeany liability for the said security breach.
The points which a user gets for scanning QR code can change as per policy and decisions of GM Modular Pvt. Ltd. and we are not entitled to give any notification to the user.
In the case of all rewards, upon redemption, the appropriate number of Points will be removed from the Account Holder’s Account.
You hereby expressly agree to receive communications by way of SMS, e-mails, mobile app, browser notifications regarding promotions or any other communication for example: Redemption of points, and/or any other messages from time to time by GM Bandhan relating to its services provided through the App.
The reward points can be redeemed by logging in the registered account via app and selecting the appropriate menu for redemption. The loyalty points shall be redeemed by the Retailer/Electrician in any of the manner as stated below: (i)-Request for fund transfer directly to the Retailer/Electrician Bank Account provided Retailer/Electrician registers the Bank Account Details by entering the required bank details in the registered account of the Retailer/Electrician. (ii)-Gift wallet (Reward Store) (iii)-Vouchers/gifts
In case of the registered user unable to access his account or for any reason including but not limited to loss of mobile phone, misuse by the third person, wrong entering the OTP, wrong password entered in such scenarios, the registered user needs to call the call center and after successful verification the call center shall assist the said user. The toll-free call center number is 1800-209-1215 and you can contact the call center at any time between 10 am to 6 pm from Monday to Friday.
All reward points are subject to availability and may be altered or withdrawn.
GM Modular Pvt. Ltd. reserves the right to reject/cancel/suspend any account if they deem it has been forged or otherwise tampered with.
Registered Account User agrees to defend, indemnify and hold harmless GM Modular Pvt. Ltd. App, its employees, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon the use of User's actions or inactions, including but not limited to any warranties, representations or undertakings or in relation to the non-fulfilment of any of its obligations under this Agreement or arising out of the User's infringement of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights.
GM Modular Pvt. Ltd. will not be liable for any loss that may incur as a consequence of unauthorized use of any collateral in connection with the loyalty program- GM Bandhan. GM Modular Pvt. Ltd. has endeavored to ensure that all the information is correct, but GM Modular neither warrants nor makes any representations regarding the collaterals.
Settlement of disputes: Terms and conditions, set herein, shall be governed by the laws of India only. All disputes arising under the terms and conditions shall be attempted to be resolved through negotiations. All claims and disputes arising under the terms and conditions should be notified to GM Modular Pvt. Ltd. within 45 working days from the event date – the date when dispute arose after which you shall not have any claim against GM Modular Pvt Ltd.
GM Modular Pvt. Ltd. shall have the right to transfer, assign and sell in any manner, in whole or in part, the Program to any third party of its choice without reference or intimation to the users.
The Loyalty Program’s membership enrollment and eligibility, earning Points, Rewards, and redemption are subject to the terms and conditions herein and are subject to any applicable laws and regulations.
GM Modular Pvt. Ltd. reserves a sole right to issue, withdraw, alter, amend the Terms and Conditions from time to time without prior notice and the updated Terms and Conditions shall be applicable on all the users (existing or new) of the GM Bandhan app.
GM Modular Pvt. Ltd. reserves the right to terminate the Program, by giving 30 working days’ notice to all Members.
Every member acknowledges, represents and warrants that he is the sole and exclusive owner of his Membership account and the only authorized user of his account's credentials. Member also accepts the sole responsibility to keep his card, number; password, account details confidential. Members are solely responsible for all the orders placed and other activities in the account (like profile changes, address change, etc.).
GM Modular Pvt Ltd. shall not be liable in the event it fails to fulfil any of its obligations under this terms and conditions due to flood, earthquake, storm, cyclone or any other acts of the god of similar nature, war, strike, lockout, or governmental or judicial or quasi-judicial policies/intervention/direction /prohibition or change in law or for any other reasons beyond its control.
The Privacy Policy forms part of the Terms and Conditions, and by accepting the above Terms and Conditions you also give your consent to GM Modular Private Limited to handle your personal data under that policy.
We warrant that services related to the Loyalty Program shall be provided with reasonable care and skill with the intention of meeting our specifications for the Services, but we cannot and do not guarantee that the same will meet your requirements.
We shall be only liable as expressly provided under terms and conditions detailed herein, and we shall have no other obligation, duty or liability whatsoever to you or anyone else in contract, tort (including negligence, breach of statutory duty and any other tort) or otherwise.
Limitation of Liability: The aggregate liability of GM Modular Pvt Ltd in connection with any claim arising out of or relating to the Platform and/or the products, information, documents and services provided herein or hereby shall not exceed the amount/points required to be credited in the users ap p wallet and that amount shall be in lieu of all other remedieswhichyou may have against us. (i)-We shall not be liable for any loss of revenue, business, anticipated savings or profits; any errors in or omissions from the Platform or any services or products obtainable therefrom, the unavailability or interruption of the Platform or any features thereof, your use of the Platform, the content and materials contained on the Platform and/or any delay or failure in performance beyond our control or any of our affiliated parties. (ii)-We shall not be liable for any indirect, special or consequential loss damage, costs or other claims, howsoever caused or arising, whether through non-supply or late supply of the Loyalty Program Services or other non-performance of these terms and conditions or otherwise.
